These Terms of Service ("Terms") govern your use of the website thecimpleco.com (the "Site") and your purchase of products from THE CIMPLE CO ("we," "us," or "our"). By accessing or using the Site, creating an account, or placing an order, you agree to these Terms. If you do not agree, do not use the Site.

6. Shipping and Delivery
Our Shipping Policy describes shipment timing, delivery destinations, carrier practices, and what happens if a shipping delay occurs. Delivery estimates are not guarantees unless we expressly say otherwise.
7. Returns, Refunds, and Limited Warranty
Our Return & Refund Policy governs 30-day returns. Our 10-Year Limited Warranty governs warranty claims. After the 30-day return window, product issues that qualify for warranty coverage are handled under the warranty terms rather than the return policy.
8. Intellectual Property
All content on the Site, including text, graphics, logos, photographs, product images, design elements, software, and compilations, is owned by THE CIMPLE CO or its licensors and is protected by United States and international intellectual property laws.
THE CIMPLE CO and related brand elements are trademarks of THE CIMPLE CO. You may not use our trademarks without our prior written permission.
9. Reviews, Comments, and Other Submissions
If you submit a review, comment, suggestion, or other content to us or through the Site, you represent that you have the right to submit it and that it does not violate the law or another person's rights.
By submitting content, you grant us a non-exclusive, royalty-free license to use, reproduce, display, publish, and distribute that content in connection with our business, subject to applicable law and our Privacy Policy.

The Site may contain links to third-party websites, payment options, or services. We do not control and are not responsible for the content, policies, or practices of third parties.
11. Limitation of Liability
To the fullest extent permitted by applicable law, THE CIMPLE CO will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to your use of the Site or your purchase or use of products from the Site.
To the fullest extent permitted by applicable law, our aggregate liability to you for claims arising out of a specific order or product will not exceed the amount you paid for that order or product.
Nothing in these Terms excludes or limits liability for personal injury or death caused by negligence, fraud or fraudulent misrepresentation, our obligations under the 10-Year Limited Warranty, or any consumer right or liability that cannot be waived or limited under applicable law.
Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.

You agree to indemnify and hold harmless THE CIMPLE CO and its officers, directors, employees, and agents from third-party claims, damages, liabilities, and expenses, including reasonable attorneys' fees, arising out of your unlawful use of the Site or your breach of these Terms, except to the extent caused by our own negligence, fraud, or willful misconduct.
13. Governing Law and Venue
These Terms and any dispute arising out of or relating to the Site or your purchase of products from us are governed by the laws of the State of Utah, without regard to conflict-of-law rules. You and we agree that any dispute will be brought exclusively in the state or federal courts located in Utah County, Utah, and each party consents to the personal jurisdiction of those courts.

We may update these Terms from time to time. When we do, we will post the revised version on this page and update the effective date. Your continued use of the Site after the revised Terms are posted means you accept the revised Terms.
15. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.

These Terms, together with our posted policies and warranty terms that are expressly incorporated by reference, constitute the entire agreement between you and THE CIMPLE CO regarding your use of the Site and your purchases from the Site.
